Abhishek Gusain

Abhishek Gusain holds a B.A. LL.B. (Hons.) from Guru Gobind Singh Indraprastha University, Delhi. He has completed a Diploma in Advanced Entrepreneurship Management and Corporate Law from Gujarat National Law University, and a Certificate Course in Intellectual Property Rights and Information Technology from the Indian Law Institute, Delhi. His academic foundation is complemented by a commitment to continual learning and professional development.

Abhishek has been enrolled with the Bar Council of Delhi since 2016 and has been a member of the Delhi High Court Bar Association since 2017.

He is an accomplished Advocate with nearly a decade of experience in litigation, arbitration, and consumer cases. He leads matters spanning across civil, arbitration, infrastructure disputes, company law, insurance, banking, real estate, consumer cases and commercial litigation.

Throughout his career, Abhishek has represented a broad spectrum of clients including government bodies, public sector undertakings, private corporations, and individual clients. His litigation practice is built upon deep domain expertise and a strategic approach to dispute resolution. He has appeared before the Supreme Court of India, various High Courts, Arbitral Tribunals, the National Company Law Tribunal (NCLT), the National Company Law Appellate Tribunal (NCLAT), the Debt Recovery Tribunal (DRT), the Debt Recovery Appellate Tribunal (DRAT), consumer fora, and regulatory authorities. He has appeared in numerous commercial and civil matters on behalf of leading banks and insurance companies.

Abhishek also has substantial experience in intellectual property law, having successfully represented clients before the Trademark Registry, the erstwhile IPAB, and the Delhi High Court in trademark registration and enforcement matters. He has conducted legal due diligence and managed filings and objections with precision and foresight. His work extends to family law and criminal law, where he has represented clients in matrimonial disputes, domestic violence cases, and cheque bounce matters.

Among his notable contributions are two reportable judgments that have had a significant impact on Indian jurisprudence. In Maya D. Chablani vs Radha Mittal (2021), he led the case resulting in a Delhi High Court ruling that affirmed the right to feed community dogs as a part of the right to life and dignity under Article 21 of the Constitution. In Tata Iron & Steel Co. Ltd. vs Jhalani Tools India Ltd. (2023), he represented a secured creditor and contributed to a landmark judgment clarifying the hierarchy and treatment of first and second charge holders in insolvency matters, with broader implications for the distribution of assets in liquidation.
